RealSwipe Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you (the "User") and RealSwipe ("RealSwipe", "we", "us", or "our"), governing your access to and use of our mobile application, website, and all related services, content, features, technologies, and tools provided by RealSwipe (collectively, the "Service").

By downloading, accessing, registering with, or using any part of the Service, you confirm that you have read, understood, and agreed to be bound by these Terms. If you do not accept or agree with any part of these Terms, you must not access or use the Service.

1. Eligibility and User Representations

1.1 Minimum Age Requirement

• You are at least 18 years old;
• You have the legal capacity and authority to enter into a binding agreement;
• You are not prohibited by law from using the Service in your jurisdiction;
• You have not been convicted of any criminal offence, including but not limited to violence, sexual misconduct, harassment, or other unlawful behavior.

RealSwipe reserves the right to request proof of age and identity at any time and may suspend or terminate access to any User who does not comply.

1.2 International Access

The Service is operated by RealSwipe, an Australian entity. We make no representations that the Service is appropriate or available for use outside of Australia. Users who access the Service from outside Australia do so at their own risk and are responsible for compliance with applicable local laws.

2. Account Registration and Responsibilities

2.1 Account Creation

To access key features of the Service, Users must create an account by providing accurate, complete, and current information. Users are responsible for updating account details to ensure accuracy.

2.2 Account Security

• Maintain the confidentiality of your password;
• Notify RealSwipe immediately of any unauthorised use of your account or suspected security breach;
• Not share your login credentials with others or allow others to access your account.

2.3 Account Deletion

You may delete your account at any time via in-app settings. Upon deletion, your profile and data will be permanently removed from our systems, except where retention is legally required.

3. Subscription Services and Billing

3.1 Premium Features

RealSwipe may offer both free services (such as basic profile creation and connecting features) and paid subscription options ("Premium Services") via the Apple App Store and Google Play Store. Premium Services may include but are not limited to:

• Enhanced visibility
• Unlimited profile views or likes
• Priority matching
• Advanced filtering options

3.2 Billing and Renewals

• Subscriptions automatically renew at the end of each billing cycle;
• You may cancel auto-renewal via your platform's subscription settings;
• Payment obligations are non-cancelable and fees are non-refundable, except as required by law or platform policy.

All transactions are processed through third-party platforms, and RealSwipe disclaims all liability relating to payment errors or refunds on those platforms.

4. Acceptable Use and User Conduct

By using the Service, you agree not to post, upload, or transmit any content or engage in any behavior that:

• Contains nudity, sexually explicit material, or pornography;
• Promotes hate, racism, discrimination, or violence;
• Harasses, threatens, bullies, or stalks other users;
• Infringes on any intellectual property, privacy, or publicity rights;
• Is misleading, impersonates another individual, or constitutes catfishing;
• Uses automated means (bots, scripts, scrapers) to access the platform;
• Interferes with or disrupts the operation of the Service;
• Involves any other illegal, immoral, or unethical conduct.

5. User Content and Licensing

Users retain ownership of content submitted or uploaded to the Service ("User Content"). However, by submitting User Content, you grant RealSwipe a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to use, store, reproduce, adapt, publish, distribute, display, and create derivative works from such content for the purpose of operating, improving, promoting, and marketing the Service.

This may include using your profile information, photos, first name, age, city, event participation, or other non-sensitive account information in marketing materials, social media promotions, advertisements, case studies, investor presentations, or other promotional content relating to RealSwipe.

RealSwipe will not use sensitive personal information (such as private messages, phone numbers, email addresses, or exact location data) for marketing purposes without your explicit consent.

5.2 Moderation

RealSwipe may monitor or review User Content for compliance but is not obligated to do so. We may remove or disable access to any content that violates these Terms or is otherwise objectionable, without notice or liability.

6. Third-Party Services and Integrations

The Service may incorporate or link to services provided by third parties. Use of these services is governed by their respective terms and privacy policies. RealSwipe is not responsible for the conduct or content of third-party services.

7. Safety Disclaimer and Limitation of Liability for Interactions

RealSwipe is a social networking and discovery platform designed to connect in real life. We do not conduct background checks or verify user identity. You are solely responsible for your interactions with other Users. Risks include but are not limited to:

• Physical harm
• Harassment or emotional distress
• Fraud, scams, or financial loss
• Criminal acts or misconduct

Always meet in public, inform someone of your plans, and comply with all local laws.

8. No Guarantee of Matches or Results

RealSwipe does not guarantee matches, outcomes, or interactions. Users are solely responsible for their choices and experiences.

9. Intellectual Property Rights

Except for User Content, all content and branding on the Service are owned by RealSwipe. You may not copy, reverse-engineer, or reuse any part without permission.

10. Termination

We may suspend or terminate your access without notice for violations of these Terms or applicable law. Your license ends upon termination.

11. Disclaimer of Warranties

The Service is provided "as is". We disclaim all warranties including availability and accuracy.

12. Limitation of Liability

RealSwipe is not liable for damages resulting from use, data loss, or interactions. Maximum liability is AUD $100 or what you paid in the last 6 months.

13. Indemnification

You agree to indemnify RealSwipe for any losses arising from your use or violations of these Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of New South Wales, Australia. Disputes shall be resolved in its courts.

15. Modifications to Terms

We may revise these Terms at any time. Continued use indicates acceptance. Check them periodically.
